Finding a Door to Walk Through and moving on

I have a recent deal that is hanging on by a thread.  I've written about it several weeks ago in I Now Pronouce You Seller and Husband, and while we thought we had ironed out the problems it seems that more have surfaced. 

A seller getting cold feet and changing her mind is one thing. 

... Refusing to sign a release is another. 

Luckily, my buyers are very reasonable people, and we've just found another home for them which we put under agreement this weekend.  Still, it would be nice to have their escrow deposit returned from the "Let's Not Make a Deal" seller behind curtain #1. 

I believe the seller would have signed the release of escrow, if the broker had not tossed in a letter telling her that they are suing her for their comission because she refuses to sell the house.  Granted, they have every right to do so, but it should be done AFTER the release and termination forms are signed.  So, now she is refusing to sign anything.

We'll go to court if we have to, but before we get that far we thought we'd try something a little different.  My buyers, not hearing any updates from the listing office for weeks, decided (with my and my broker's encouragement) to write the seller a letter directly.  And, it worked!  They wrote a heartfelt letter about how they understand her circumstances (which I won't go into here) and how they would really like to work with her but at this point they need to move on.  They asked her to please sign the escrow release, and included a copy of the document.  They also included a self-addressed stamped envelope.

As a last minute thought, they added their cell phone number in the letter just in case she decided she wanted to talk to them.  And guess what?  She called them the next day.  Receiving the letter was appreciated, and she explained to them (just as I suspected) that the listing broker is threatening to sue for commission.  She understands now that the buyers have nothing to do with that, as it is between her and her agent and broker.  She agreed to sign the release and will mail it to them. 

We did let her know, of course, that we would take her to court if necessary -- hey, I'm no pushover -- but it seems that won't be the road we'll be needing to take.  Whatever happens now is between her and her broker, who should have done a better job of trying to keep the lines of communication open for all parties. 

They shut the door on her, she shut the door on them, and the buyer and I were left standing outside on our own. 

Luckily, we found another doorway to enter, and it seems things will work out.

And, we are in escrow for another home - so all is good!

I admit that I have a gripe about how this was handled, and the broker was far more interested in his comission than in getting a release signed and communicating to all parties.  Not my problem, as long as my buyers are free to move on.

Tax Credits - Energy Credits and KOZ Business Credits for Pennsylvania

I received a very informative newsletter from my accountant's office today, and I thought I would pick out a few highlights of the AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009  a.k.a - the Bail Out.

Personally, I was a bit surprised and I have to admit, impressed, with some of the credits that have been increased or extended for both, individuals and businesses.

Here are a few of the highlights that are beneficial (hopefully) to current and future homeowners:


First-Time Homebuyer Tax Credit


The First-Time Homebuyer Tax Credit increases to a maximum of $8,000, eliminating any payback after living in the home 36 months. This will apply to first-time homebuyer purchases of a principal residence from January 1, 2009 through December 31, 2009.

The credit begins to phase-out when AGI exceeds $75,000 ($150,000 for joint filers).

This applies only to homes purchased after December 31, 2008.  Homes purchased earlier than 2009 will be governed by the original first-time homebuyer credit with full payback with a maximum credit of $7,500.

Residential Energy Property Credit - This is great for those looking to improve their current homes, or for those who are purchasing a bit of a fixer-upper:

The agreement increases the residential energy property tax credit from 10% to 30%, and raises the maximum cap to an aggregate of $1,500 for installations during 2009 and 2010. If you made qualifying improvement in 2009 - keep track of this!

Eligible improvements include

 

  • insulation,
  • exterior windows and doors,
  • central air conditioners,
  • natural gas, propane or oil water heaters or furnaces,
  • hot water boilers,
  • electric heat pumps & water heaters,
  • metal roofs,
  • and advanced main air circulating fans. 

Pre-2008 credits are not counted toward the $1,500 maximum.


Residential Energy Efficient Property Credit - GO GREEN, IT PAYS OFF!


The credit cap is removed for residential energy efficient solar hot water property, geothermal heat pumps, and wind energy property!

FOR BUSINESSES WHO ARE LOOKING TO EXPAND AND BUILD NEW OPERATIONS - CONSIDER A "KOZ":

SALES AND USE TAX EXEMPTION FOR KEYSTONE OPPORTUNITY ZONE BUSINESSES

Pennsylvania has expanded the sales and use tax exemption for businesses constructing in a Keystone Opportunity Zone. According to Pennsylvania Senate Bill 1412, a business may purchase services or tangible personal property, other than motor vehicles, exempt from sales and use tax if these items are purchased for the exclusive use, consumption, or utilization at a facility located within a Keystone Opportunity Zone (KOZ) or a Keystone Opportunity Expansion Zone (KOEZ).

In June 2008, the Pennsylvania Senate signed an amended Senate Bill 1412 to include certain purchases of services or tangible personal property by construction contractors for use in a construction contract with a qualified KOZ business, landowner, or lessee. However, this bill was not effective until September 2008. In order for a qualified contractor to take advantage of this exemption, the construction contract with the eligible KOZ business, landowner, or lessee must be dated on or after September 8, 2008. This expansion of the sales and use tax exemption will apply to any qualified purchases made by a general contractor or subcontractor.

Keystone Opportunity Zones and Keystone Opportunity Expansion Zones are selected underdeveloped and underutilized commercial or industrial properties which provide little to no tax burden to businesses who develop in those areas. These zones were enacted to help promote economic growth and development in those selected areas. There are currently 12 Keystone Opportunity Zones located in Pennsylvania.

If I could only "mulligan" this winning Texas Hold'Em game!

Yet another "Mulligan" post.  I've been enjoying walking down memory lane, and finding some of my past "favorite" posts.  This is one that I wrote just over a year ago and believe it was my first "featured" post.  After that, I was hooked!

I haven't played Texas Hold'em for some time now ~ at least not since I traded in the iPhone I didn't like too much (I downloaded a Texan Hold'em game that I loved!).

We had some friends over last night for a last-minute game of Texas Hold' em. 

We used to get together during previous summers every Thursday night for a game.  The loser, or first one out, was always charged with the task of firing up the grill and making hot dogs for the rest of us who were still playing - as a penalty for being the first one out. 

We had a good time last night.  And, most importantly - I won!  Too bad there was only four of us playing, and the winnings weren't that big, but nonetheless I got to add my name to the list of winners we've been keeping. Of course, winning isn't everything (who am I kidding?) but:  
It occurred to me that buying a house is very much like a game of Texas Hold 'Em:   

    "You've got to know when to Hold Them, know when to Fold Them, know when to Walk Away, and know when To Run" (was it Kenny Rogers that sang that song?).

Ante Up - As a home-buyer you've got to "ante up" and start looking for a good Realtor and Lender.  You're thinking of buying, but you have a few steps to take before you can walk away with that Royal Flush of a house.  So, you start playing a numbers game, playing with loan calculators, surfing the internet for listings, going to open houses, talking to friends and family who've bought homes recenlty. Ante up - You've got to be in it, to win it!

Placing a Bet - Once you've placed your Ante and you have found your perfect Buyer's Agent, you've got your loan pre-approval in the works, you can start betting that what you've got in hand so far will help you obtain the right house - or that Royal Flush you're hoping for.  You're checking the chips that you've got stashed away for your down payment and closing costs, and you're keeping a close eye on them, hoping you won't need to go "all in" -- but you are ready to do so if the cards are in your favor.  

The Flop - This is a biggie.  "There's the house that seems just right for you!"  Bidding starts, and you hope you've made a sound enough bid to clear the table of the other players.  It looks good - offer accepted -- and now you're really in the game!  You've got your deposit check handed in, a sealed deal, and hopefully can see this thing to the end of Settlement, or The River.  

Lancaster Real Estate TipsThe Turn - Well, before you get to The River some things can happen. That "house of cards" you've been building can come tumbling down!  Whole house inspection, Termite inspection, title search, final loan commitment -- do you keep playing? Are the cards that have been dealt good enough to see you through to the end?  Or, are you going to get "burned"?  Do you cut your losses now and Fold?  Are those cards good enough to hang on until "The River"? Or do you "walk away" or "run"?  So much to think about!!  You might already have everything perfectly lined up, with the perfect winning hand, and you go "ALL IN"Or do you hold back just a bit, hoping for that last card to pop up to make everything work out?  Perhaps it's the sale of your own house coming through.  Perhaps a glitch in the title search that needs to be worked out.  This is where things can all Turn suddenlyYou're confident -- and you go "All In" to see "The River" card.  

 

The River - It can make the game or break it -Home Buying Royal Flush
It's the day of Settlement - you're at the table with your
Realtor, the Closing Agent, and your Lender.  The Seller is there with his representation.  The stacks of mortgage documents comes out - and you try hard to understand everything!  You think you know what is going on, but of course you're a bit nervous.  Some last minute betting - or re-negotiating - because the Seller didn't move everything out in time, or forgot to leave the kitchen sink as promised.  But you're confident you've got the winning hand.  The deed is presented to you, signed by the seller and properly notarized.  You sign that HUD --and show your "winning hand"!   A Royal Flush!!  That house is all yours!! (your Winnings!)   Keys are exchanged, the garage door opener is handed to you, and congratulations and high fives go around the table.  You don't only feel like a winner -- YOU ARE A WINNER and now you're A HOMEOWNER, TOO!  

The bottom line is -- if you have a great Realtor dealing your cards, you will be dealth that Royal Flush.  She may even have an Ace up her sleeve for you, if you need it!

Now, I wonder if I would have been so inspired to have thought of this stuff if I had LOST the game last night.  Probably not, as I would have been the one making the hot dogs for everyone else still playing.

Not a dead-end move -- Just a dead-end street

The dream lives on....

Through the fog of the current state of affairs -- the economy, the housing market, the uncertainty in the air -- I had a joyful experience yesterday. 

I was closing on a listing of mine, and in the lobby of the settlement office I met the buyers for the first time.  Young buyers.  Very, very young buyers.  They reminded me of myself just a few years ago (okay, many, many years ago).  I was their age when I purchased my first home, a mere babe of 22 years old.

So... here they were... These young buyers, with their hard-earned money and NO seller assist purchasing their first home.  They were so excited, and while the young lady sat and twirled her pony tail as we talked she confided to me of how their 6-month search for the right home was "such a long time"!  I told them that there are buyers much older then they who are searching for just the right home for much longer than that.  Perhaps at such a young age they don't have as high expectations as us older folks do.

Fate led them to this little brick semi-detached home on a dead-end street.  Certainly it's not a dead-end move for them, and I hope instead  that it becomes the launchpad for propelling them into a secure future of homeownership.  In their beginnings of their adulthood, and while still attending school, they saved enough for their first home.  How exciting is that!

I love it.  I love my job.  And, they weren't even my clients!  But my seller felt the same, and did what she could to make this as smooth a transaction as possible for these youngsters. 

There is hope for this industry of ours.  The buyers are still out there; the young are still dreaming of homeownership; and there is a light at the end of the tunnel for our market to turn around and shine once again, just like the faces of this young couple did across the settlement table yesterday.

Congrats to Jeremy and Victoria ~ and many, many happy and healthy years in your new home!

Regulating New Home Builders in Pennsylvania - what does the future hold?

A new proposal for a State House Bill targets unscrupulous home builders in Pennsylvania who never deliver on  their promises.  The Bill proposes that homebuilders would have to pay $300 each year, funding the New Home Builder Guaranty Fund, and register with the PA State Attorney General's office.  The intention is to keep customers from losing deposit funds paid to builders who in turn never build the agreed-upon home.

The Bill has been drafted by Rep. Frank Andrews Shimkus from Lackawanna County, in response to an upcoming trial focused on a consumer who had been ripped off by a builder, accused of taking a deposit and never building the home, bilking the consumer out of $50,000. 

The Bill, known as the New Home Construction Consumer Protection Act, would require that the registration fees be used to pay back customers who win a judgement against a fraudulent homebuilder.  If a consumer chooses to use a homebuilder who is not registered with the state, they would not be covered by the proposed bill.

If House Bill (HB) 1821 were to be enacted, Pennsylvania builders would be subject to background checks and would be given state registration numbers.  Is this such a bad thing?  Personally, although I am not fond of government intervention from many angles, I feel this is a good measure to weed out the bad seeds and protect consumers from losing what could be their life savings.

There are similar Bills in place already in the states of California and Florida, where continued education and testing is required by builders.  Could Pennsylvania be far behind?  Most members of The Home Builders Association of Metropolitan Harrisburg are against the Bill, fearing that ethical builders will have to shoulder the burden of criminal or fraudulent businesses in the industry.  It's true in every industry though, including the lending and real estate sales industries.  Why should builders not be regulated as well?

This seems to be the general opinion if you are a Lancaster real estate buyer, and you are absolutely right.

Your Realtor can Keep you in "hot water" .. or ..

I had a past client (first time buyer) send me a text message the other day that went something like this:

Client:  It looks like it's time for me to call that Home Warranty -- I can't get the hot water heater to stay fired up.

Me:  Wow, good thing we insisted on that!

Client:  It's at about that 10 year mark we talked about, so I'm not surprised.

Me:  (To myself) wow, he paid attention during his home inspection!  :-)

Yet, I started asking questions because I did not want him to call in a claim on his Home Warranty, only to find out later that it would not be a covered item.   

So, as we texted back and forth, I quickly look through a Home Warranty plan to double-check.  Yup.  It looks like it would be a covered item.  Still, I had this nagging feeling.


Me: Is the water heater electric or gas?

          Client:  It's gas.  No, electric.  No, gas.  I can't keep the pilot light lit.

Me.  hhmmm.... I hope it doesn't need cleaning or servicing, as the Warranty would not cover it if it has not been maintained.

Then, I remembered a past conversation about a propane heater in the garage.  As I texted to him some more, I looked up his previous MLS and Sellers Disclosure.......  Sure enough "Hot Water Heater:  Propane".


Me:  Are you out of PROPANE??!!! 

Client:  UUUHHHH.....  gee.  Maybe!  No wonder I couldn't keep the oven hot last night!  I'm such an idiot! (I swear he said that, not me!) :-)

Me:  you know, I just SAVED you huge bucks on a non-covered service call!  You owe me, big time!

Client:  You Rock!  Can I buy you a cup of coffee!

Me:  That would work.  But, I'd rather have a referral!   (Hey, it NEVER hurts to ask!)

Client:  You got it!  If I ever hear of anyone wanting to buy a house, you're it!  (see, it NEVER hurts to ask!)

You see?  A Realtor can be a valuable source of information (and SAVINGS) to their past client, and in return they can be a wealth of referrals for the Realtor.  It works both ways! 

I am happy to report that my past client can now stop taking cold showers, since he found the cause of his non-working water heater.  Before we were done texting back and forth, he called the propane supplier for a delivery -- and was happy!  It can't get any better than that!

Lancaster Real Estate -- Playing the game of "seller's assistance"

I could have sold a listing today, only the buyer and seller could not see eye to eye regarding "seller's  assistance" .  The seller just couldn't believe that the buyer would ask for such a huge amount towards closing costs, and can't justify paying it out of her pocket for someone who does not have the cash to purchase the home of their choice.  I have to admit that I agreed with her. 

This home was just listed recently -- a very nice, well-cared for home, and most importantly it is priced accordingly.  Imagine our surprise when we saw the amount of seller's assistance that the buyer wanted. 

Now, I know how the ballgame works, and sometimes there is no harm in asking for seller's assistance. Let's play ball!  But, when the home has been on the market for just over a week, there is almost no point in going right for the jugular.  You'll just end up striking out that way.  It was our turn to bat, and we ended up countering the offer with a figure that we felt was very fair and accomodating to their needs, and the buyer refused it and walked away.  It seems they need the entire amount financed, and can't "play in the game" without it.  I'm sure they'll find a seller who is a bit more desperate and would be willing to accomodate them, but it won't be this one.  Yer' outta here!

The other agent seems to be a newbie (no harm in that -- I was one too at some point), but whoever has been "coaching" her on how to play fair failed to tell her that not every seller will accept an offer with seller's assistance, and also failed to tell her that not every seller in Lancaster County is going to be so desperate to sell! She felt there was nothing wrong with her pitch offer, and was apparently told that it was the way to go when putting in an offer and playing ball.  I guess she'll learn the old fashioned way -- trial and error.

In the meantime, we'll wait for the right -- qualified -- buyer to come along and pitch a new offer to us.  Hopefully, the innings will be longer, this time!

Lancaster PA Real Estate - The Unravelled Deal

A week ago I wrote about a transaction that was just barely Hanging On by a Thread.  The seller had not  disclosed certain defects and was hard to get in touch with, let alone act responsible to getting repairs done in a timely manner.  The listing agent was no better!  This transaction was for a Lancaster City multi-unit investment property. 

This transaction is no longer hanging on by a thread, but by now has completely unravelled!  You know how you find a thread hanging loose, and then you pull it?  And keep pulling it?  And it doesn't end... it will just eventually cause the cloth to unravel completely while you're feeling like you're getting tied up in knots?  That's what this entire transaction was like!

Not only were there a number of code violations and repairs that needed attention, but the listing description had a number of errors regarding whether the tenant or the landlord pay for certain utlities.  This is important stuff when you are evaluating an investment property!  To believe that the tenants pay for their own heat, and then to find out that in reality the landlord pays to the tune of over $3,700 per year, is quite disturbing!  To believe there is additional income from the included coin-op laundry machines, then to learn the tenants have been allowed to install their own washers in their apartments -- with no increase to cover the costs of water -- is quite disturbing!  The list goes on...

Just as I expected, the seller is downplaying the majority of these necessary repairs and errors in the listing description.  My buyer is backing out and refusing to purchase the property.  I can't say I blame him.  But who wants to purchase a property with a leaky main sewer line that the seller did not disclose and does not want to repair?  Or a property where the majority of the drainpipes from the bathrooms and tubs are completely clogged?  Was there really a need to wash all of the paint rollers and dump the remaining paint in the tub drain while working on some other repairs? 

Anyway, it was suppose to close today, but it's a dead deal.  It's too bad that I spent so much time on this transaction, and that my buyer spent good money on the inspections and loan applications, etc.  But, it's better that he walked away.  I actually encouraged him to do so!  I just can't feel good about a transaction if I truly don't feel it's in the buyer's best interest. 

So, while I am waiting for the Release to the Agreement of Sale form to come back signed from the seller, I notice this property has already been placed as Active on the Lancaster MLS.  Just as I suspected, the corrections to the MLS regarding who pays for what (which would severely affect the net return on investment) have not been corrected.  I haven't checked the Sellers Disclosure form to see if the certain defaults were disclosed yet, but something tells me they probably have NOT been changed.

You win some, you lose some.  I definitely feel the buyer is the winner in this case.  Nobody needs to purchase someone else's problems if they aren't going to be forthcoming and disclose the material defects or fess up to the incorrect MLS data. 

If you are looking for a Lancaster City investment property, this is a fine example of why you must work with a Buyer's Agent to look out for your best interests.  I know of one property in particular that you should stay away from!
